User-Generated Content (UGC) Terms – ComfortFlex®

Thanks for sharing your adventures with ComfortFlex® gear! These UGC Terms explain how we may use content you share with us or tag on social media.
1) What counts as “UGC”
“UGC” means photos, videos, captions, reviews, stories, and other content you create that features our products or brand.
2) How we ask for permission
Tagging us or using our hashtags does not by itself grant permission. We request rights in one of two ways:

Reply consent: We comment/DM and ask you to reply #YesComfortFlex (or similar clear phrase) agreeing to these UGC Terms; or
-
Form consent: You submit our UGC Consent form (linked from our DM or site).
We keep a record of your consent (post link, handle, date/time).
3) The license you grant
When you grant permission (via reply or form), you give ComfortFlex® a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use your UGC—including your handle, display name, caption text, and likeness—in any media, including:
- Our website(s) and apps
- Emails and SMS
- Organic social posts and paid advertising
- In-store materials, packaging, and PR
- We may edit for layout/format (e.g., crop/resize), but we won’t alter the meaning.
4) Credit & links
We aim to credit you by handle or name where reasonably practical (e.g., “📸 @yourhandle”). Some placements (like small mobile tiles or printed materials) may not allow a visible credit.
5) Eligibility & your promises
You confirm that:
- You are 18+ (or your parent/guardian is granting permission on your behalf).
- You own the content or have permission from the rights owner(s).
- Anyone recognizable in the content has given permission (parent/guardian consent for minors).
- The content does not infringe any rights or contain unlawful, unsafe, or misleading claims.
- Depictions follow safe, humane animal handling.
6) Incentives & disclosures
If we provide any value (e.g., product, discount, contest entry) connected to your UGC, that is a material connection and may require disclosure. We may add or request clear disclosures (e.g., “Includes incentivized content”) when we publish.
7) What we won’t feature (moderation)
We may refuse or remove UGC that shows: unsafe product use, animal cruelty, harassment/hate, nudity/explicit content, competitor logos as the main focus, medical/therapeutic claims, or anything off-brand or unlawful.
8) How to withdraw permission (takedown)
Changed your mind? Email support@comfortflexharness.com with:
- Your handle
- Link(s) to the original post(s)
- Where you saw it used (e.g., product page)
We’ll remove the content from our controlled channels within a reasonable time. This won’t affect uses already completed (e.g., printed materials) or reposts by others we don’t control.
9) Reviews & community posts on our site
If you submit a review, Q&A, or upload media on our site, you grant us the same license as above. We may display, edit for length/clarity, and share excerpts.
10) Instagram and third-party embeds
Embedded posts load third-party services that may set cookies. You can control those services’ settings in your account. Where required, we’ll only load embeds after you opt in.
11) No compensation (unless we agree otherwise)
UGC permissions are granted without payment, unless we make a separate written agreement with you.
12) Our trademarks
You may reference ComfortFlex® to describe your content. You may not use our logos/trademarks in a way that suggests you are us or that we endorse you, unless we’ve agreed in writing.
13) Limitation of liability
To the maximum extent permitted by law, ComfortFlex® isn’t liable for indirect or consequential damages arising from our use of your UGC in accordance with these Terms.
14) Changes
We may update these UGC Terms from time to time. We’ll post the new date at the top. Changes apply going forward and don’t retroactively alter prior consents.
15) Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
